State Legislation Against Copay Accumulators

Several states now have laws requiring insurers to count copay assistance paid by or on behalf of an enrollee toward their annual deductibles and out-of-pocket limit. Similar legislation is currently pending in several other states.

These laws generally apply to individual, family, and small group health insurance plans, but may not apply to insurance provided by large employers.
